By accessing or using Daily Howdy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Daily Howdy is not a medical device, diagnostic tool, or clinical instrument. It does not diagnose, treat, cure, or prevent any disease or condition. The trend data and patterns shown in the app are observational and informational only.
Daily Howdy is not a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about cognitive health — yours or someone else's — consult a qualified healthcare provider.
Description of the service
Daily Howdy provides daily games designed for pairs of people (typically a caregiver and a senior) to play together. The Service includes game play, comparison views, mood check-ins, streak tracking, and an optional trend dashboard.
Accounts and eligibility
You must be at least 18 years old to create a caregiver account. By inviting a senior to use the Service, you represent that you have their consent to do so. Senior accounts may be created without an email address via device-bound sessions.
Subscription and billing
Daily Howdy offers a Family Plan subscription at $8/month. New accounts receive a 14-day free trial with no credit card required. After the trial, you will be prompted to subscribe to continue using partnership features. You may cancel at any time from your account settings.
Refunds are handled on a case-by-case basis. Contact hello@dailyhowdy.com for billing questions.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use automated systems to access the Service in a manner that exceeds reasonable use.
- Impersonate another person or misrepresent your relationship with another user.
Intellectual property
All content, design, and code comprising the Service are owned by Daily Howdy and protected by applicable intellectual property laws. You retain ownership of any personal content you submit (game answers, mood notes, etc.).
Limitation of liability
To the maximum extent permitted by law, Daily Howdy and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
In particular, Daily Howdy is not responsible for any medical decisions made based on trend data or patterns observed in the app.
Termination
We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time by contacting hello@dailyhowdy.com.
Changes to terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law provisions.
